VILLA MARKET JP COMPANY LIMITED including persons involved in personal data processing under the orders or on behalf of Villa Market JP Company Limited, hereinafter collectively referred to as "the Company," is committed to protecting customer privacy, whether in collection, use, and/or disclosure, to comply with the Personal Data Protection Act B.E. 2562 (2019). The Company therefore issues this announcement to inform you about rights and duties, as well as various conditions regarding the collection, compilation, use, and disclosure of personal data.

4. Personal Information of Children Under 10 Year Olds / Incapacitated or Quasi-Incapacitated Persons by Court Order
The company will not intentionally attract children under 10, incapacitated persons, or quasi-incapacitated persons by court order. If we unknowingly collect personal information from or about any person under 10 years of age, incapacitated person, or quasi-incapacitated person by court order, the company will delete such personal information from its records. However, the company may collect personal information pertaining to children, incapacitated persons, or quasi-incapacitated persons by court order directly from their legal representatives, guardians, or curators, provided explicit consent is obtained from such individuals.

To achieve the purposes specified in this Privacy Notice, the Company may need to disclose or share specific data only as necessary to business partners, service providers, or external agencies, such as information technology services, data recording services, accounting audit services, payment services, postal services, parcel delivery services, printing services, insurance services, data analysis services, research services, marketing services, or any other services that may benefit you or relate to the Company's business operations, etc. The Company will prepare personal data processing agreements as required by law.
The Company may disclose or share personal data to affiliated companies, where data processing will be under the purposes specified in this Privacy Notice only.
Laws or legal processes require data disclosure, or disclosure to officials, government officers, or authorized agencies to comply with lawful orders or requests.
6. Transfer or Forwarding of Data to Foreign Countries
The Company may send or transfer personal data to foreign countries, such as Cloud Servers, to backup your personal data, ensuring that the destination country or destination agency has adequate and appropriate personal data protection standards at international levels.

4. ข้อมูลส่วนบุคคลของเด็ก / คนไร้ความสามารถหรือคนเสมือนไร้ความสามารถตามคำสั่งศาล
บริษัทจะไม่เรียกร้องหรือจัดเก็บข้อมูลส่วนบุคคลจากเด็กหรือคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถตามคำสั่งศาล ถ้าบริษัทพบว่าได้จัดเก็บข้อมูลส่วนบุคคลจากเด็กหรือคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถตามคำสั่งศาลโดยไม่ได้เจตนา บริษัทจะลบข้อมูลส่วนบุคคลของเด็กหรือคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถตามคำสั่งศาล ออกจากบันทึกของบริษัท อย่างไรก็ตาม บริษัทอาจจัดเก็บข้อมูลส่วนบุคคลเกี่ยวกับเด็กหรือคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถตามคำสั่งศาล จากผู้แทนโดยชอบธรรมหรือผู้อนุบาลหรือผู้พิทักษ์โดยตรง และเมื่อได้รับความยินยอมอย่างชัดแจ้งจากบุคคลดังกล่าว
5. การส่งต่อและเปิดเผยข้อมูลส่วนบุคคล
บริษัทจะไม่เปิดเผยและส่งต่อข้อมูลส่วนบุคคลของท่านไปยังหน่วยงานภายนอก เว้นแต่ได้รับคำยินยอมชัดแจ้งจากท่าน หรือเป็นไปตามกรณีดังต่อไปนี้
เพื่อบรรลุวัตถุประสงค์ตามที่ระบุในประกาศความเป็นส่วนตัวฉบับนี้ บริษัทอาจจำเป็นต้องเปิดเผยหรือแบ่งปันข้อมูลเฉพาะเท่าที่จำเป็นแก่คู่ค้า ผู้ให้บริการ หรือหน่วยงานภายนอก เช่น การให้บริการด้านเทคโนโลยีสารสนเทศ บริการบันทึกข้อมูล บริการชำระเงิน บริการส่งสินค้า บริการจัดพิมพ์ บริการประกันภัย บริการวิเคราะห์ข้อมูล บริการทำการวิจัย บริการการทำการตลาด หรือบริการอื่นใดที่อาจเป็นประโยชน์ต่อท่าน หรือเกี่ยวข้องกับการดำเนินธุรกิจของบริษัท เป็นต้น โดยบริษัทจะจัดทำข้อตกลงการประมวลผลข้อมูลส่วนบุคคลตามที่กฎหมายกำหนด
บริษัทอาจเปิดเผยหรือแบ่งปันข้อมูลส่วนบุคคลให้แก่บริษัทในเครือ โดยจะเป็นการประมวลผลข้อมูลภายใต้วัตถุประสงค์ที่ระบุในประกาศเกี่ยวกับความเป็นส่วนตัวฉบับนี้เท่านั้น
กฎหมายหรือกระบวนการทางกฎหมายบังคับให้เปิดเผยข้อมูล หรือเปิดเผยต่อเจ้าพนักงาน เจ้าหน้าที่รัฐ หรือหน่วยงานที่มีอำนาจเพื่อปฏิบัติตามคำสั่งหรือคำขอที่ชอบด้วยกฎหมาย
6. การถ่ายโอนหรือส่งต่อข้อมูลไปยังต่างประเทศ
บริษัทอาจส่งหรือโอนข้อมูลส่วนบุคคลไปยังต่างประเทศ โดยจะทำให้แน่ใจว่าประเทศปลายทางหรือหน่วยงานปลายทางมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอและเหมาะสม
7. การปกป้องข้อมูลส่วนบุคคล
บริษัทจะใช้มาตรการทางเทคนิค และการบริหารจัดการที่เหมาะสมเพื่อป้องกันและรักษาความปลอดภัยของข้อมูลส่วนบุคคลของท่าน โดยมีการเข้ารหัสสำหรับการส่งข้อมูลผ่านเครือข่ายอินเทอร์เน็ตและควบคุมการเข้าถึงข้อมูลส่วนบุคคลของท่านเฉพาะผู้เกี่ยวข้อง ทั้งในส่วนของข้อมูลที่จัดเก็บในรูปแบบเอกสารและอิเล็กทรอนิกส์
8. ระยะเวลาในการจัดเก็บข้อมูล
บริษัทจะเก็บรวบรวมข้อมูลส่วนบุคคลของท่านไว้ตลอดระยะเวลาตราบเท่าที่จำเป็นต่อการประมวลผลตามวัตถุประสงค์ในประกาศฉบับนี้เท่านั้น เว้นแต่มีความจำเป็นต้องเก็บข้อมูลส่วนบุคคลไว้ด้วยเหตุอื่นใด เช่น เพื่อปฏิบัติตามกฎหมายหรือการตรวจสอบกรณีการเกิดข้อพิพาท บริษัทอาจมีความจำเป็นต้องเก็บข้อมูลไว้เป็นระยะเวลาเกินกว่าที่ระบุ
9. การเปลี่ยนแปลงประกาศเกี่ยวกับความเป็นส่วนตัว
บริษัทอาจแก้ไขเพิ่มเติมประกาศเกี่ยวกับความเป็นส่วนตัวโดยจะประกาศบนเว็บไซต์ของบริษัท https://shop.villamarket.com/privacy-policy และช่องทางอื่น ๆ พร้อมระบุวันที่แก้ไขเพิ่มเติมครั้งล่าสุด บริษัทแนะนำให้ท่านตรวจสอบประกาศนี้เป็นประจำ ทั้งนี้ การที่ท่านใช้งานเว็บไซต์ของบริษัทต่อไปหลังจากที่มีการเปลี่ยนแปลงประกาศเกี่ยวกับความเป็นส่วนตัว จะถือว่าท่านยอมรับประกาศที่เปลี่ยนแปลงนั้นแล้ว
10. สิทธิของเจ้าของข้อมูลส่วนบุคคล
ท่านสามารถขอใช้สิทธิต่างๆ ตามที่กฎหมายกำหนดและตามที่ระบุไว้ในประกาศฉบับนี้ได้ดังต่อไปนี้

11. นโยบายทั่วไป
บริษัทฯ ทำหน้าที่เป็น ผู้ควบคุมข้อมูล (Data Controller) สำหรับข้อมูลบุคคลภายนอก และมุ่งมั่นในการเก็บรักษาข้อมูลให้ปลอดภัยจนกว่าจะถูกทำลาย มีการแต่งตั้ง เจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล (DPO) และจัดทำนโยบายเป็นลายลักษณ์อักษร เผยแพร่ให้บุคลากรและผู้เกี่ยวข้องรับทราบ
